Another Companion Animal Destroyed by Providence Animal Control (September 2, 2010)
Tyson came to Friends of Attleboro Animal Shelter at the end of March of 2010. He was under the standard 10 day quarantine that all strays are put under in Attleboro. On April 5, 2010, immediately after those 10 days were up he was Neutered and given all Vaccines (Parvo, Rabies, Distemper) and Heartworm tested (negative).
In May / June 2010 Tyson was diagnosed with IBD which is Irritable Bowel Disease. He was given medication daily and on a strict Diet of Holistic Lamb based food and only natural Lamb based treats.
Later in July / early August 2010, Tyson was diagnosed with borderline Thyroid issues and was put on a medication which he took twice daily. Other than the IBD and the Thyroid Tyson was a Healthy 5 year old Dog.
On Saturday August 28, 2010 Tyson went with his potential adopter Louis DiBacco at approximately 10am. Louis was very excited to have Tyson join his family and Louis was under the mindset “to bring Tyson with him to places and get him out to meet and greet”. Later on in the day he took Tyson to visit friends in Providence, RI. At around 5:30/6:00pm Tyson slipped from his lead and took off running down Enfield Street in Providence. Louis notified Providence Police and left a message on the Voicemail at Attleboro Animal Shelter and Providence Animal Shelter, as he continued to search for Tyson.
Sunday August 29, 2010 when Attleboro ACO’s arrived, they took note of his message and Volunteers were notified of Tyson’s disappearance. By 8:30am Two Volunteers from Friends of Attleboro Animal Shelter headed right down to Providence to try and find Tyson. We immediately searched the area calling Tyson’s name and squeaking his favorite Ducky toy and went door to door. At around 11am we proceeded to Providence Animal Shelter, where we followed an ACO Van into the Shelter driveway. We ran right over to the Animal Control Officer’s Van with a picture of Tyson and asked “have you seen this dog”? , we were told “nope, don’t look familiar”. We then explained what happened and with No enthusiasm the Providence ACO told us…”do you know how many of THOSE dogs are out there”? He proceeded to tell us they were not open and to call back at 11am on Monday. We then headed back to Attleboro Animal Shelter, where other Volunteers were ready to help in the search and had prepared 100 Fliers of Tyson to start posting in Providence. At around 1:00pm on Sunday August 29, 2010 Three Volunteers headed back into Providence to Start pounding the pavement and distribute and hang fliers. We placed 100 Fliers in the area of Enfield St, Smith St.,Admiral St., Chad Brown projects and the many side streets in the area of Providence College. We returned back to the Attleboro Animal Shelter at around 4:00pm and regrouped, posted Ads on Facebook and Craigslist, yahoo k9 Amber Alert Group, Emailed the flier to the general email of providence Animal Shelter at animal@providenceri.com, and prayed for some siting calls, which we received none.
Monday August 30, 2010, I called Providence Animal Shelter at 11:00am when they opened. They were asked if there were any “Tyson Sitings” and “did you get the flier that was emailed over to you”? The Answer was “No we have not picked up any dogs matching your description (White Bulldog/Pit mix with a Brown patch over his right Eye), and that an email should be sent to Dave Holden at 'dholden@providenceri.com”, which was sent that day at 11:18am with a copy of the Flier and the info on his situation. They were told that we would be in the area distributing more fliers and to please call with any info, as Tyson is a friendly dog who needs medication. We continued to look, walking and talking to everyone, posting fliers and calling Tyson’s name – again with no luck.
Later in the evening on Monday August 30, 2010 at 5:00pm several more Volunteers of Friends of Attleboro Animal Shelter and members of our community headed back into the Providence area to look for Tyson. We refused to give up and had more Fliers printed and we continued to pound the pavement looking for Tyson, knocking on Doors, hanging up Fliers And begging for assistance on Facebook and Craigslist. Again, we had no sitings, no tips, but we refused to lose hope.
Tuesday August 31, 2010 at approximately 6:30pm we went back into Providence with more fliers, knocking on more doors, hanging fliers in local stores, giving them to Providence Police, Cabs, Busses – anyone we could hand a flier to we did…we just wanted to find Tyson!
Wednesday September 1, 2010 I received a call on my Cell (which was the number listed on the Fliers) from a gentleman who resided at 467 Admiral Street in Providence. He proceeded to say Tyson was in his backyard on Saturday August 28th around 10:00pm and he called Providence Police Department to let them know. He stated they gave Tyson some water and put a blanket out, but did not want to move him as one of the Tenants in the house saw him get hit by a car and he was limping. Animal Control finally came to that location around 1:00am or so based on reports from a tenant also residing at 467 Admiral Street.
After getting off the phone with Isaac, a cal was made to various ER Vets in the area since Providence Animal Control was unreachable at that time. That is when we learned that MA/RI Euthanized a dog that may fit Tyson’s description – he was euthanized Saturday August 28, 2010 at approximately 2:00am in the back of the Providence Animal Shelter’s vehicle.
I then proceeded to reach out to Friends of Attleboro Animal Shelter volunteers who could goto the Providence Shelter and get to the bottom of this horrific situation. Two Friends of Attleboro Animal Shelter Volunteers sat at the Providence Shelter waiting for them to open. At around 11:20am they decided to open the doors to the public and the Volunteers entered the Shelter armed with several pictures of Tyson then asked the famous question “have you seen this dog”? AGAIN the answer was “No”. The Volunteers continued to question the Animal Control Officers, and at that time were told again “no we have not seen your dog”! One ACO proceeded to say “do you know how many of THOSE breeds we see each day”? After about 30 minutes of bickering with Providence Animal Control Officers, One finally admitted and said “oh yeah I did pick up a dog at that location Saturday – but he had parvo and we euthanized him”. Then he stated that it is the law, they immediately cremate Parvo dogs and there was no way of knowing for sure if it was Tyson or not. The Volunteers refused to accept that and continued to question them in hopes of confirming whether it was Tyson or not. At that time one of the Volunteers ran out to her car and grabbed her laptop where there were many more pictures of Tyson and that is when a female staff sitting at the desk got out of her seat and went out back. A few moments later she came back and said “oh yea I think your dog is out back” and at the time the two Friends of Attleboro Animal Shelter volunteers were walked to a walk-in freezer outside and confirmed by Identification that indeed it was our baby Tyson.
Providence Animal Shelter was called daily at around 11:15am when they opened, 1:00 figuring it was after lunch and 2:45 before they closed and was always told “sorry we don’t have your dog”. We were doing everything that Providence Animal Shelter suggested via their website for a Lost Dog and then some! We are a determined group looking for a loved dog and reached out thru any and all channels possible. How could this happen? They knew…how could they not? They thought Tyson was just “another one of THOSE dogs”….well he wasn’t and because we didn’t walk away and accept their answers we were able to find our darling Tyson…lying lifeless and cold all alone with nobody to love him in Providence Animal Shelter’s Freezer.
About 20 minutes after leaving the Providence shelter after identifying Tyson’s dead body, we called providence to say “we want his body – Tyson needs to come home, our ACO is coming to get him” and that is when they said “NO it is against the law to bring him across state lines”. I found that interesting – as they transported him across state lines before and after they authorized his execution. Providence told us he would be cremated on Thursday September 2, 2010 and we could pick up his ashes on Friday September 3, 2010.We hung up and called right back again and said we are going to ask out Vet to come out there and get a sample from Tyson, to prove he was healthy and they proceeded to tell us “sorry he is in the incinerator as we speak”.
Let me refresh some things here…….The Same Animal Control officer (Michael Disano) that was personally handed the flier on Sunday morning admitted he was the one who picked him up that night (August 29th). This was the ACO that said “nope haven’t seen your dog” just 8 hours after electing to have him killed! I cannot help but wonder how can he forget about a dog he just had killed hours before he was handed a flier on that same dog? Officer Michael Disano told us that on that Saturday evening he saw Tyson at the location he was dispatched to, called for him to “come here” and Tyson did. At that Time Tyson was exhausted, scared and very thirsty (can you blame him?). He also stated that Tyson smelled of Parvo…he said “you know that smell”, which is why they state they elected to euthanize Tyson.
I know Providence is on the Alert after they were recently under quarantine for Parvo. However, let’s not forget what the reports made public state…the only dogs Euthanized by Providence Animal Shelter during their outbreak….were “those kinda dogs”, you know..dogs like Tyson. Officer Michael Disano and Dave Holden gave us a brief summary of the events that night. They simply said Officer Michael Disano drove Tyson to MA/RI Veterinary and elected to have him Euthanized as he had Parvo. Tyson never went into the Vet office, he was Euthanized in the back of a dark ACO Van. At that time they were suppose to cremate him as they stated that is the law…but they never did he was placed in the freezer at the Providence Animal Shelter for another 3 days.
Let me remind you as Tyson’s story is long……Tyson was fully up to date on his Vaccinations he was a 5 year old adult dog who was in the same location since March until that one day. Yes he had IBD which caused issues with his stools and being hit by a car will cause Anal glands to express which do smell quite strong…..Tyson played with all dogs at the Attleboro Shelter (except 2 that are not dog friendly)….all our dogs were tested the day we identified Tyson…not to anyone’s surprise ALL are negative!
What they didn’t know or seem to care about is that Tyson wasn’t just “one of those dogs” he was a dog that was loved, cared for, vetted and now missed! He was truly a phenomenal dog full of love and life that they sucked right out of him! Anyone who met Tyson loved Tyson….THAT is the kind of dog Tyson was!

PROVIDENCE - Prompted by complaints by animal-rights advocates, Police Chief Dean Esserman is launching a review of operations at the city animal shelter.
Esserman will conduct the review and then make recommendations to Mayor David N. Cicilline, according to Karen Southern, a mayoral spokesperson.
The decision to look into operations at the Providence Municipal Shelter came after leaders of the Defenders of Animals Inc., alleged that dogs and cats are being starved and mistreated at the facility off Allens Avenue.
Dennis Tabella, director of Defenders of Animals, met with Cicilline and Esserman yesterday morning to discuss the animal shelter.
In a statement issued before the half-hour meeting, Tabella said he planned to present photos, written statements and eyewitness accounts to bolster his position.
There are serious problems at the Providence Municipal Shelter," Tabella said. Among them, Tabella said, he has reason to believe that cats and dogs are not being fed on a regular basis.
And, last month, the group blasted shelter officials for sidestepping a new city ordinance that bans the use of the gas chamber to destroy stray animals; animal-rights advocates discovered that some stray animals were being put to death at a carbon- monoxide chamber in Smithfield.
Tabella's organization succeeded in obtaining a temporary restraining order to keep the animals from being destroyed by carbon monoxide, which is determined to be less humane than the more- expensive lethal injection.
In late June, Smithfield town officials temporarily halted the practice of allowing other municipalities to destroy animals in its gas chamber for $10 each.
Still, animal-rights advocates believe that city animal-control officers may be unnecessarily destroying cats and dogs, according to Tabella's statement. They maintain that the dogs and cats deserve better treatment.
They planned to ask Cicilline to make drastic changes" at the animal shelter, including removing shelter employee Frederick C. Mickey Bailey.
Bailey a convicted felon who was fired from his job in the Department of Public Works more than 20 years ago served time for sexual assault and other crimes, but was reinstated to the city payroll last summer, after an arbitrator ruled that the city was wrong to deny him a job.
Bailey, who works the night shift, cleans cages at the shelter.

Under the new law, a shelter cannot kill an animal if a rescue group is willing to save that animal's life. It also makes convenience killing illegal. Shelters can no longer kill an animal when there are available cages elsewhere. The Defenders of Animals Board of Directors' Secretary, Maureen Morse, will be coordinating this effort in Rhode Island. PROVIDENCE, R.I. -- Rhode Island's top veterinarian says efforts to reduce the state's population of wild cats have fallen short and that euthanasia may be the answer.
"I just don't see another solution to it." said state veterinarian Scott Marshall "The solutions we have tried are ineffective."
Marshall says that feral cats are a health risk to humans and other animals because of the diseases they potentially spread, including parasites, feline HIV and rabies, which has been detected in a few cats in the past few years. He has proposed requiring animal control officers to impound "roaming and feral cats" and mandating that animal shelters accept them and put them to death.
Dennis Tabella, director of Defenders of Animals, calls the idea "inhumane and outrageous" and says that "no cat, domestic or feral, that spends time outdoors, will be safe."
"If this becomes law, your neighbor will be able to take your cat and turn it over to a shelter where you cat is likely to be euthanized," he says.

Sen. John J. Tassoni Jr., on behalf of the state Department of Environmental Management, has introduced a bill drafted by Marshall. But following Tabella's rebuke of the legislation, Tassoni says he will withdraw it.
"I put them in, and now I am starting to get some calls and complaints," Tassoni said on Friday. "I made a decision to pull all of the bills and basically concentrate on jobs, the economy and the budget. I can't be chasing around feral cats when I've got people out of work."
Marshall doesn't have any estimates of feral cat populations, but he is not backing away from the premise of the bill. He said that since the introduction of the legislation, he has discussed the issue with several municipal animal control officers.
"What we have been talking about is forming a working group to evaluate what measures are working and what measures are not working," he said. "I'm open to trying other methods .... I'm hopeful that something like that comes out of it."
But, he said, "I'm not very optimistic. If this is the only means we have left, it's a regrettable move, but it's something we have to take."

Greyhound Injuries Hi Rhode Island greyhound advocates!
Today, we released our report on injuries suffered by dogs racing in Texas. In 2008, there were nearly 350 injuries, and some dogs were injured repeatedly. Twenty dogs died while racing or were euthanized.
Just as in Massachusetts and New Hampshire, Iowa and Arizona, the majority of injuries were broken legs but broken backs, and in this case ripped off toes, were not unheard of.

On August 12, 2009, UPC (United Poultry Concerns) President Karen Davis sent a letter to Little Rhody owner, Eli Berkowitz, urging him to feed his hens after learning that the company removes the hens' food to force them to lose 15 to 20 percent of their body weight. Mr. Berkowitz has declined to disclose how many days the hens sit in their cages with nothing to eat.

Of the deaths, 89 involved dogs, 17 involved cats, 3 involved birds, 1 involved a monkey, 1 involved a rat, and 1 involved a parrot. Of the injuries, 42 involved dogs and 10 involved cats. Of the losses, 8 involved dogs, 24 involved cats, and 1 involved a bird. In addition, 3 of the injured dogs were reported to have died of their injuries. Moreover, 2 of the lost dogs and 1 of the lost cats were reported to subsequently have been recovered, while 1 of the lost cats and 3 of the injured dogs were reported to subsequently have died.

Although DOT is responsible for publishing the monthly reports of deaths, injuries, and losses, federal standards for the transportation of animals also are set by the Animal and Plant Health Inspection Service ("APHIS"), a division of the U.S. Department of Agriculture. These standards are based on the Animal Welfare Act (7 U.S.C. § 2131, et seq.; “AWA”).
APHIS has adopted regulations which generally require proper care for animals during transportation (including Title 9, Section 2.100 and Title 9, section 2.131 of the Code of federal Regulations). Further, APHIS has adopted specific regulations for the transportation of dogs and cats (Title 9, Section 3.13 - 3.19 of the Code of Federal Regulations); guinea pigs and hamsters (Title 9, Section 3.35 - 3.41 of the Code of Federal Regulations); rabbits (Title 9, Section 3.60 - 3.66 of the Code of Federal Regulations); nonhuman primates (Title 9, Section 3.86 - 3.92 of the Code of Federal Regulations); marine mammals (Title 9, Section 3.112 - 3.118 of the Code of Federal Regulations); and other animals (Title 9, Section 3.136 - 3.142 of the Code of Federal Regulations).
USDA has sanctioned various air carriers for violations of the Animal Welfare Act. Only one order appears to have been issued that concerned an incident which occurred after DOT’s reporting requirements entered into effect. (Additionally, not all of the earlier incidents necessarily would have been reportable even if the current DOT reporting requirements were in effect - i.e., shipments of animals by dealers). Stephanie Lane PROVIDENCE, RI (WPRI) - A rally is underway at the State House in attempt to end Greyhound Racing in Rhode Island.
The rally consists of members from GREY2K USA, Defenders of Animals, VSA, the Humane Association of Northwestern RI, and the West Warwick Angels.
The rally is in attempt to stop Rhode Island legislators who want to override the Governor's veto; the veto would end Greyhound Racing in the state in August.

Donations & Foster Home needed Meet Aubrey the superstar! Aubrey is a 14-year old chocolate lab with an absolutely endearing personality and a tail that always wags. Gloomy day? Aubrey will gladly cheer you up and give you a paw. Of course she will expect one (or two, three or five…) of her special treats in return! Aubrey has spent a few days with a local veterinarian who’s given her lots of water, food, love and medical care which resulted in her gaining 4 lbs! Yeeaah Aubrey! It turns out that Aubrey has severe diabetes. Lack of treatment has resulted in her emaciated condition-when rescued she was 32 lbs.-not at all a dignified weight for this special lady! Aubrey had a big car ride to another veterinarian where she will be monitored and have additional tests. Aubrey’s stay at the local veterinarian was paid for by local animal control and all future costs will be the responsibility of Defenders of Animals, so GUESS WHAT? Aubrey is unable to hold down even a part time job right now so she is asking for your financial support. She on insulin treatment, antibiotics and will be having additional testing because the vet suspects she has other medical conditions. She may need an ultrasound, other expensive tests and possible specialty care depending on additional diagnoses. All Aubrey’s veterinarians have given us generous discounts (THANK YOU!!) but we need to raise money to cover her care and testing which may run into the thousands of dollars. Foster home needed: We are also looking for an extraspecial foster home for Aubrey. Aubrey can not have vaccinations in her weakened state so she can not be with other animals. Foster parent qualifications will include: familiarity with needles, injecting insulin, the disease of diabetes and signs of hypoglycemia, ability to provide specialty care such as sub-q fluids if necessary. We would prefer to place Aubrey in a home where someone will be home most of the day to monitor her. She requires very frequent bathroom breaks as well. You may wish to comment on this story at ABC 6 link. The film footage came to Defenders of Animals and was turned over to ABC 6. There are a number of issues regarding this story. There are numerous cats missing from the area, there is a question as to how these ducks were obtained, and there is certainly a problem with the way that they were slaughtered. RI Dog Killer Is Sentenced
Defenders of Animals submitted a Community Impact Statement in accordance with Title 12, Criminal Procedure, Chapter 12-28 Victim’s Rights, Section 12-28-4, which was read in the court room by Judge Stephen P. Nugent and pointed out by Special Assistant Attorney General Mark Trovato.
Defenders of Animals respectfully requested the Court to sentence Edgar Goulet to the maximum sentence of two years for shooting and killing his pit-bull type dog.
Special Assistant Attorney General Mark Trovato was the prosecutor in the case.
Having sat through the new trial request by Mr. Goulet and the sentencing for over four hours today, I can tell you that Special Assistant Attorney General Mark Trovato from the RI Attorney General’s Office did a tremendous job presenting the evidence against Mr. Edgar Goulet.
“Judge Stephen P. Nugent gave Edgar Goulet, 60, two years in prison for maliciously killing the dog, Sparky, after it ran away from him two years ago. He sentenced Goulet to 10 years, with two to serve concurrently with the first count, for possession of a sawed-off shotgun that police found tucked under his couch cushions. The remaining eight years would be suspended with probation.
"There is no doubt in this court's mind this defendant is a danger to the community," Nugent said.
Goulet has been held at the Adult Correctional Institutions since a Washington County Superior Court jury found him guilty of both counts in May.
The judge rejected a motion for a new trial before sentencing.”

How Could You? (May 5, 2008)

HOW COULD YOU? By Jim Willis, 2001
When I was a puppy, I entertained you with my antics and made you laugh.
You called me your child, and despite a number of chewed shoes and a couple of murdered throw pillows, I became your best friend.
Whenever I was 'bad,' you'd shake your finger at me and ask 'How could you?' -- but then you'd relent and roll me over for a belly-rub.
My housebreaking took a little longer than expected, because you were terribly busy, but we worked on that together.
I remember those nights of nuzzling you in bed and listening to your confidences and secret dreams, and I believed that life could not be any more perfect.
We went for long walks and runs in the park, car rides, stops for ice cream (I only got the cone because 'ice cream is bad for dogs' you said), and I took long naps in the sun waiting for you to come home at the end of the day. Gradually, you began spending more time at work and on your career, and more time searching for a human mate.
I waited for you patiently, comforted you through heartbreaks and disappointments, never chided you about bad decisions, and romped with glee at your homecomings, and when you fell in love.
She, now your wife, is not a 'dog person' -- still I welcomed her into our home, tried to show her affection, and obeyed her. I was happy because you were happy.
Then the human babies came along and I shared your excitement. I was fascinated by their pinkness, how they smelled, and I wanted to mother them, too. Only she and you worried that I might hurt them, and I spent most of my time banished to another room, or to a dog crate.
Oh, how I wanted to love them, but I became a prisoner of love.
As they began to grow, I became their friend.
They clung to my fur and pulled themselves up on wobbly legs, poked fingers in my eyes, investigated my ears and gave me kisses on my nose.
I loved everything about them and their touch -- because your touch was now so infrequent -- and I would've defended them with my life if need be.
I would sneak into their beds and listen to their worries and secret dreams, and together we waited for the sound of your car in the driveway.
There had been a time, when others asked you if you had a dog, that you produced a photo of me from your wallet and told them stories about me.
These past few years, you just answered 'yes' and changed the subject.
I had gone from being 'your dog' to 'just a dog,' and you resented every expenditure on my behalf.
Now, you have a new career opportunity in another city, and you and they will be moving to an apartment that does not allow pets.
You've made the right decision for your 'family,' but there was a time when I was your only family. I was excited about the car ride until we arrived at the animal shelter. It smelled of dogs and cats, of fear, of hopelessness.
You filled out the paperwork and said 'I know you will find a good home for her.'
They shrugged and gave you a pained look.
They understand the realities facing a middle-aged dog, even one with 'papers.
You had to pry your son's fingers loose from my collar as he screamed 'No, Daddy!
Please don't let them take my dog!' And I worried for him, and what lessons you had just taught him about friendship and loyalty, about love and responsibility, and about respect for all life.
You gave me a good-bye pat on the head, avoided my eyes, and politely refused to take my collar and leash with you.
You had a deadline to meet and now I have one, too.
After you left, the two nice ladies said you probably knew about your upcoming move months ago and made no attempt to find me another good home.
They shook their heads and asked, 'How could you?'
They are as attentive to us here in the shelter as their busy schedules allow. They feed us, of course, but I lost my appetite days ago.
At first, whenever anyone passed my pen, I rushed to the front, hoping it was you that you had changed your mind -- that this was all a bad dream... or I hoped it would at least be someone who cared, anyone who might save me.
When I realized I could not compete with the frolicking for attention of happy puppies, oblivious to their own fate, I retreated to a far corner and waited.
I heard her footsteps as she came for me at the end of the day, and I padded along the aisle after her to a separate room.
A blissfully quiet room.
She placed me on the table and rubbed my ears, and told me not to worry.
My heart pounded in anticipation of what was to come, but there was also a sense of relief. The prisoner of love had run out of days.
As is my nature, I was more concerned about her.
The burden which she bears weighs heavily on her, and I know that, the same way I knew your every mood. She gently placed a tourniquet around my foreleg as a tear ran down her cheek.
I licked her hand in the same way I used to comfort you so many years ago. She expertly slid the hypodermic needle into my vein.
As I felt the sting and the cool liquid coursing through my body, I lay down sleepily, looked into her kind eyes and murmured 'How could you?'
Perhaps because she understood my dog-speak, she said 'I'm so sorry.
She hugged me, and hurriedly explained it was her job to make sure I went to a better place, where I wouldn't be ignored or abused or abandoned, or have to fend for myself -- a place of love and light so very different from this earthly place.
And with my last bit of energy, I tried to convey to her with a thump of my tail that my 'How could you?' was not directed at her.
It was directed at you, My Beloved Master, I was thinking of you. I will think of you and wait for you forever. May everyone in your life continue to show you so much loyalty.

3/20/2008 Humane group: Animals are suffering in Smithfield shelter By GERRY GOLDSTEIN, Valley Breeze & Observer Correspondent Chief McGarry denies charges
SMITHFIELD - Alleging that animals at the town shelter are being subjected to mistreatment ranging from lack of medical attention to starvation, a group of volunteers and shelter fund-raisers is seeking a Town Council investigation.
Their charges, which they have detailed in written presentations given to council members Tuesday - but too late for inclusion on that night's meeting agenda - drew strong rebuttals from Police Chief William A. McGarry, whose department runs the shelter, and Deputy Chief Richard P. St. Sauveur Jr., who oversees the operation.
But the volunteers, who say they have stopped working at the shelter because they felt intimidated and unwelcome there, cite a litany of abuse.
They say that sick animals are left in filthy bedding, go without veterinary attention sometimes to the point of near death, and suffer from general inattention.
Additionally, a group that over the last six years has raised more than $43,000 to help shelter animals - at events such as rummage sales and spaghetti suppers - says that the Police Department now refuses to accept any of the money they raise, much of it offered to assure veterinary services.
In fact, some of the shelter critics say they have had to resort to subterfuge, pretending to walk sick or emaciated dogs, while in reality taking them to the vet.
Deputy Chief St. Sauveur confirms that his department does not accept the privately raised money, saying he has been assured by the town manager that if supplemental money is ever needed for animal care, it will be supplied.
He termed the two shelter employees, Animal Control Warden Thomas Taylor and assistant Robert Salisbury, "professional and hard-working. They are very caring individuals when it comes to the needs of the animals at the shelter."
St. Sauveur said that he has been reviewing shelter operations for months, sometimes with unannounced inspections, and that while he has recommended some minor changes he has concluded that "the animals are well-fed, well cared for, and are provided with adequate food, water and medical care."
Not so, says Judy E. Chase, founder and past president of Smithfield's Animal Shelter Aid Program (ASAP), the registered, tax-exempt charity that has raised money for animal care.
She says that relations with the shelter deteriorated so badly that "volunteers have smuggled food into the shelter . . . and they have taken literally hundreds of sick animals to the vet's," quietly paying the bills with aid program money despite the police department's ban on accepting it.¬ ¬ ¬ ¬
Bethany Mott, a volunteer who is head of circulation at the East Smithfield Public Library, says her three years of volunteering at the shelter, from 2002 to 2005, were filled with anxiety and pity for animals that she felt were ill-cared for.
"I was welcome there as long as I didn't make a fuss or speak up for the animals," she said.
She said she was often told, when complaining about animal needs, that the town couldn't afford what she suggested.
She said it was her experience that animals "hardly ever got veterinary care, even with open wounds."
"It was obvious cruelty," she said, adding that she saw three days' accumulation of feces in dog runs, mold in dog food, and maggots. "I could do nothing about it because if I spoke up I would be asked to leave," she said.
Another volunteer, Nicole Waybright, a mechanical engineer and former Navy officer who is fluent in Spanish and now runs a home business translating technical documents for international companies, supplied The Breeze & Observer with a list of incidents among many that she says she witnessed at the shelter.
These include instances where sick or injured animals were allegedly left in enclosures full of urine and feces, with food containers out of reach.
She contends also that medications were not given properly, that illnesses were not adequately evaluated, and that she and other volunteers personally witnessed "examples of animals being left in cages to die of starvation, dehydration, heat exhaustion, and general lack of care."¬
Waybright says the shelter, at 3 Spragueville Road, off Pleasant View Avenue behind the Public Works garage, averages three to four dogs and five to six cats at any given time. Springtime brings a flood of kittens.
The volunteers said they are going public because although they were told last summer that St. Sauveur was investigating, they have been unsuccessful in obtaining any report from him.
They also allege bad relations with Chief McGarry that stem from the group's support several years ago of a bill, eventually passed, that eliminated animal gas chambers in Rhode Island, including Smithfield's.
McGarry said he disagreed with the bill's provisions, but characterized the accusation of a grudge as "absolutely untrue and unwarranted. That's really unfair to me - I'm not that kind of guy."
He said despite his personal opposition, "That was a state law, and we honor state laws."
Deputy Chief St. Sauveur told the newspaper he feels that the volunteers' dissatisfaction is rooted in their desire to see more done for animals than a shelter is designed to provide, and that sometimes they insist on a level of care beyond shelter capabilities.
"This is a temporary facility, and while animals are here they are adequately cared for," he said, adding of the allegations, "I have not observed such things, and the staff cares far too much for these things to occur."
Waybright's e-mail communication with St. Sauveur over a period of months last year and this year show a continuing concern over additional issues:
* No specific item in the town budget for animal medical expenses.
* No outside expert such as a veterinary technician to be responsible for periodic visits to manage medication.
* "Needless suffering" from such maladies as untreated urinary blockages and massive infections.
* No concrete plan for emergency veterinary services at odd hours when local vet offices are closed.
Both the police chief and deputy chief said the issue boils down to one of control: whether members of their department or the volunteers are going to exert authority at the shelter. ¬
Meanwhile, the complaints have caught the attention of Smithfield Democratic state Sen. John J. Tassoni Jr., who was largely responsible for the law banning gas chambers in favor of lethal injection.
Tassoni said he does not know at this point if the charges are valid, but he told The Breeze & Observer the Town Council "should take this seriously."
Noting that he, himself, has contributed money to ASAP, Tassone questioned why the shelter is refusing donations from dedicated residents, especially in a time when the municipal budget is tight.
"This is very upsetting to me," he said. "My hope is that all the allegations are false, but if, in fact, they are true, the Town Council needs to step up to the plate and put the appropriate people in charge of that shelter."
Council members on Tuesday had no time to read the volunteers' reports and they were not discussed, especially since the state's open meetings law requires agenda items to be posted several days in advance of meeting times.
Waybright said the volunteers will ask the council to put their concerns on the agenda for its next meeting, scheduled for Tuesday, April 1, at 7 p.m. in Town Hall.

Animal Fighting Legislation in Rhode Island (Sunday, December 16, 2007)
12-13-07 Sen. Tassoni bills target animal fighting, animal abuse
STATE HOUSE - High profile as it is, the Michael Vick case is not unique. Animal fighting, specifically, and animal cruelty in general is an unfortunate but persistent part of human activity.
Sen. John J. Tassoni Jr. (D-Dist. 22, Smithfield, North Smithfield) is sickened by animal abuse and animal abusers and has spent years in the General Assembly fighting it through new and stronger laws. Among his achievements is the 2006 law that established a breeder permit program for cats, featuring a spay/neuter program to control the cat population in the state and prevent the euthanization of thousands of malnourished and ill feral cats.
This year, Senator Tassoni has prefiled three bills to be taken up during the 2008 session that add more protections for animals from abuse and neglect, including one bill calling for higher fines and imprisonment for convictions related to animal fighting.
"Michael Vick (Atlanta Falcons ex-quarterback) is getting lots of media attention, but it's the mistreatment to the animals that cannot be overlooked," said Senator Tassoni. "Protecting animals from abuse and neglect is not just about punishing abusers but also about enacting laws to extend the kind of humane treatment animals deserve."
While animal fighting, owning fighting animals and attending animal fights is already outlawed in Rhode Island, Senator Tassoni's bill would make imprisonment for violations mandatory, not an option as currently provided by law. The imprisonment would still be for a period of up to two years. In addition, fines for anyone convicted of staging, promoting or betting on bird, dog or animal fights would be increased, with the minimum fine rising from $1,000 to $2,500 and the maximum fine increasing from $5,000 to $10,000.
"This kind of activity is nothing short of barbaric," said Senator Tassoni. "The penalties associated with it should be severe."
Another bill prefiled by Senator Tassoni for consideration when the General Assembly convenes in January would establish a new section of state statute, requiring the courts to issue animal protective orders against persons found guilty of animal abuse. The bill would also allow an agent of the Rhode Island Society for the Prevention of Cruelty to Animals or a municipal animal control officer to petition the district or superior court to confiscate any animal owned by a person guilty of abuse.
The final bill would increase various penalties related to animal cruelty. Basic fines for those guilty of mistreatment or neglect, which are now $50 to $500, would grow to a range of $100 to $1,000. Anyone guilty of malicious injury to or of killing animals would face a mandatory two-year jail sentence, a fine of up to $2,00 and a total of 50 hours of community restitution. Anyone guilty of violating current registration and filing procedures for animal research would face a $1,000 fine, up from the current $500.
"There must be accountability and punishment that fits the crime in cases where a pet or any other animal is neglected, abused, tortured or killed," said Senator Tassoni. "Pets and other animals have little or no defense, and it's our job to protect them."

BOYCOTT WAL-Mart (December 7, 2007)
Boycott Wal-Mart WJAR-TV Friday, December 7, 2007 COVENTRY, R.I. - A Wal-Mart employee accused the Coventry store of animal cruelty after she said management hired someone to shoot birds that fly into the building.
The woman, who did not want to be identified, works part time at the Wal-Mart Supercenter in Coventry. She said she's seen it happen three times in the two years she's been working there.
"It's inhumane for them to kill these birds the way they're doing it," the woman said.
The store manager told NBC 10 that an outside contractor was hired to eliminate a problem with birds, but did not confirm if the birds were shot.
The employee said she felt compelled to draw attention to the way the giant retailer gets rid of birds that fly into its store.
"They actually have a gentleman come into the store and shoot them down with a BB gun," she said. "They are putting them to their death."
NBC 10 tried to contact the company that Wal-Mart said it uses to eliminate the birds but did not get a response.
The employee said she and other associates at the store have voiced their concerns to management.
"They said they're trying to do everything, and we feel that they're not doing enough," she said.
Jami Lamontagne, a Wal-Mart spokeswoman, issued a statement that said in part, "We do our best to remove animals from our stores in a safe and timely manner. With 127 million customers coming through our door each week, our doors are opened frequently and sometimes a bird might happen to fly in."
Lamontagne continued to say that, "Wal-Mart strives to comply with all rules and regulations regarding animal treatment and will attempt to humanely shoo the birds back out the doors."
Dennis Tabella of the Defenders of Animals called for people to boycott Wal-Mart during the holidays because of its treatment of the birds.
"We think it's dangerous," he said. "We think there are many other humane alternatives that the store could be using to chase away the birds."
The employee agreed.
